Former Teacher Sexually Assaulted Girl Under 16 In Atlantic City: Prosecutor

A Delaware man who was formerly a teacher has been sentenced to New Jersey state prison for sexually assaulting a student under 16 years old, authorities said.

Thomas Herlihy, 37, of New Castle, Delaware, was sentenced Friday to seven years in a treatment facility for sex offenders, according to Acting Atlantic County Prosecutor Cary Shill.

Herlihy’s sentence is to be served at the Avenel facility because he was found to be a repetitive and compulsive sex offender, Shill said. Herlihy will be subject to Megan’s Law registration and Parole Supervision for Life, as well as being prohibited from any type of contact with the victim pursuant to Nicole’s Law.

The charges are a result of an investigation into an alleged sexual relationship that Herlihy had with a juvenile under the age of 16 at the time, Shill said.

Herlihy allegedly had supervised the girl while she was a student at the school where he was a teacher, the prosecutor said.

Herlihy was charged with multiple acts of sexual penetration that he committed against the juvenile victim while they were visiting Atlantic City together on or about June 1, 2016, Shill said.

The investigation was conducted by Delaware State Police and the FBI with assistance from the Atlantic County Prosecutor’s Office. 

Assistant Atlantic County Prosecutor Marisa G. McGarvey is handling the case.
